Terms and Conditions

1. Who We Are
These Terms and Conditions govern your use of the Zzzello app and services. Zzzello is operated by Zzzello LLC, 3445 Midway Drive E 207, San Diego, CA 92110. You can contact Zzzello app support at hello@zzzello.com.

Zzzello helps you discover hotels, compare rates, access member pricing, and start hotel bookings. Zzzello is not a hotel, hotel operator, payment processor, travel agency for flights, or accommodation provider.

2. Booking Partner
Hotel inventory, rates, availability, booking fulfillment, payment handling, cancellation handling, refunds, and booking-related customer service are provided by Nuitée and its hotel, payment, and supplier partners.

When you book a hotel through Zzzello, you authorize Zzzello to send the booking information needed to Nuitée so Nuitée and its partners can process and manage the hotel reservation.

Your hotel booking may also be subject to Nuitée's terms, hotel supplier rules, rate rules, cancellation policies, payment terms, and any rules shown during checkout or in your booking confirmation. If those booking-specific rules conflict with these Terms on a hotel booking issue, the booking-specific rules control for that hotel reservation.

3. Acceptance
By using Zzzello, creating an account, searching hotels, accessing member pricing, or starting a booking, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use Zzzello or complete a booking through the app.

4. Eligibility
You must be at least 18 years old to create a booking.
You must have authority to book for each guest named in the reservation.
You must provide accurate account, guest, contact, payment, and travel information.
You must comply with hotel rules, local laws, travel documentation requirements, and supplier policies.
You are responsible for charges, penalties, fees, taxes, deposits, incidentals, and cancellation costs tied to your booking.

5. Account and Member Pricing
Zzzello may require an account or email address to access member pricing, saved preferences, favorites, booking details, confirmations, cancellations, support, and marketing messages.

You are responsible for keeping your account credentials secure. You must contact us at hello@zzzello.com if you believe your Zzzello account has been used without permission.

6. Hotel Search and Information
Zzzello displays hotel content, rates, taxes, fees, availability, amenities, cancellation rules, and other booking information from Nuitée, hotels, and supplier partners. Rates and availability can change until Nuitée confirms the booking.

We work to show accurate information, but hotel content may include errors, missing details, outdated photos, or supplier mistakes. You should review the hotel name, address, dates, room type, occupancy, cancellation policy, taxes, fees, and total price before booking.

7. Booking Process
Before you submit a booking, you must review the full checkout details. Once you confirm a booking, Zzzello sends the required information to Nuitée for processing.

A booking is not final until Nuitée or its supplier confirms it.
Nuitée or its supplier may reject, cancel, or fail to confirm a booking if the rate is unavailable, payment fails, fraud checks fail, supplier rules are not met, or the booking information is incomplete or incorrect.
You should not make non-refundable travel plans until you receive a confirmed booking reference.
Booking confirmations, cancellation messages, and booking updates may be sent by Zzzello, Nuitée, or their service providers.

8. Payments
Hotel payments are handled by Nuitée and its payment providers. Zzzello may collect or pass checkout information needed to start payment, but Zzzello does not store full payment card numbers in the app.

By submitting payment information, you authorize Nuitée and its payment providers to charge the payment method for the booking amount, applicable taxes, fees, cancellation costs, no-show charges, and other amounts disclosed during checkout or required by the booking terms.

Your bank, card issuer, payment provider, hotel, or local authority may charge additional fees, deposits, exchange-rate costs, resort fees, tourist taxes, incidentals, or local charges. Some charges may be paid directly at the hotel.

9. Cancellations, Changes, and Refunds
Cancellation, amendment, refund, and no-show rules depend on the hotel rate, supplier terms, Nuitée terms, and the policy shown during checkout or in your confirmation.

Some bookings are non-refundable or cannot be changed.
Refund timing depends on Nuitée, suppliers, payment providers, banks, and card issuers.
If you need help with a hotel booking, cancellation, refund, hotel issue, or booking change, use the booking support contact details in your confirmation or contact Nuitée booking support through the available booking-support path.

10. Hotel Stay
Hotels set their own check-in rules, check-out rules, age rules, deposit rules, smoking rules, pet rules, accessibility details, incidental policies, amenity availability, and local fees.

You are responsible for presenting required identification, payment cards, travel documents, visas, health documents, and any other information required by the hotel or local law.

11. App Support and Booking Support
Zzzello app support: Zzzello handles questions about the app, account access, app bugs, saved preferences, favorites, recent searches, and Zzzello marketing emails. Contact hello@zzzello.com.
Nuitée booking support: Nuitée handles hotel booking support, including booking fulfillment, payment issues, cancellations, refunds, hotel issues, and supplier questions.

12. Privacy
Zzzello collects and shares information as described in our Privacy Policy. This includes sharing booking, guest, contact, payment, cancellation, and support information with Nuitée and its partners when needed to provide hotel booking services.

We may use your email address for account access, member pricing, booking confirmations, cancellation updates, support, and Zzzello marketing. You can opt out of marketing emails, but transactional booking and account messages may still be sent.

13. App License
Zzzello grants you a limited, revocable, non-exclusive, non-transferable license to use the app for personal hotel search and booking purposes, subject to these Terms.

You may not copy, modify, reverse engineer, scrape, resell, or misuse the app or its content.
You may not use Zzzello to commit fraud, abuse supplier rates, make speculative bookings, interfere with the app, or violate law.
Zzzello may suspend or limit access if we believe your use creates risk, violates these Terms, or harms Zzzello, Nuitée, suppliers, hotels, users, or the app.

14. Intellectual Property
Zzzello, the Zzzello name, app design, app content, logos, software, and related materials belong to Zzzello or its licensors. Hotel content, supplier content, trademarks, and third-party materials belong to their respective owners.

15. Third-Party Services
Zzzello uses third-party services for hotel inventory, booking fulfillment, payments, authentication, maps, hosting, analytics, diagnostics, email delivery, and support. Your use of those services may be subject to third-party terms and policies.

16. Disclaimers
Zzzello provides the app on an as-is and as-available basis. We do not guarantee uninterrupted app access, error-free content, constant hotel availability, specific rates, or hotel performance.

Hotels, suppliers, Nuitée, payment providers, and other third parties control the hotel services, booking fulfillment, payment handling, cancellation handling, refunds, hotel operations, and booking support. Zzzello is not responsible for hotel acts, omissions, overbooking, denied check-in, service quality, amenities, local fees, safety issues, force majeure events, or supplier failures, except where the law does not allow that limitation.

17. Limitation of Liability
To the maximum extent permitted by law, Zzzello LLC will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from your use of the app or a hotel booking.

To the maximum extent permitted by law, Zzzello's total liability for claims related to the app will not exceed the greater of the amount you paid directly to Zzzello for the app service at issue or USD $100. This limit does not apply where the law does not allow it.

18. Indemnity
You agree to defend and hold harmless Zzzello LLC, its owners, employees, contractors, and partners from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of the app, inaccurate information, violation of these Terms, violation of law, or violation of third-party rights.

19. Travel Requirements
You are responsible for passports, visas, health documents, travel advisories, sanctions restrictions, immigration rules, and any legal requirements that apply to your trip. Zzzello does not provide legal, immigration, health, or travel-safety advice.

20. Changes to Zzzello or These Terms
Zzzello may update the app, change features, remove features, change support paths, or update these Terms. If we update these Terms, we will update the date above and make the revised Terms available in the app.

Your continued use of Zzzello after updated Terms are posted means you accept the updated Terms.

21. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where consumer protection laws require a different governing law. Booking-specific disputes may also be subject to Nuitée terms, supplier terms, hotel terms, payment-provider terms, or mandatory local law.
